1. Acceptance of Terms

By accessing or using BodmasBooksAI ("the Service"), operated at bodmasbooksai.abacusai.app and bodmasbooksai.co.za, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

BodmasBooksAI is a SaaS platform that uses artificial intelligence to generate personalized cold emails for sales outreach. The Service operates on a credit-based subscription model with Free, Starter (R499/month), and Pro (R999/month) plans.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You may register using email/password or Google Single Sign-On.

4. Subscription & Payments

Paid subscriptions are billed monthly through Paystack, a PCI-DSS compliant payment processor. By subscribing to a paid plan, you agree to:

• Automatic recurring monthly charges at your selected plan rate in South African Rand (ZAR)
• Credits resetting at the start of each billing cycle (unused credits do not roll over)
• Our Refund & Dispute Resolution Policy

You may cancel your subscription at any time by contacting [email protected]. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Generate spam, phishing, or fraudulent communications
• Violate any applicable anti-spam laws (including CAN-SPAM, GDPR, POPIA)
• Harass, threaten, or defame any person or entity
• Generate content that is illegal, harmful, or infringes on intellectual property rights
• Attempt to reverse-engineer, exploit, or disrupt the Service
• Share, resell, or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. AI-Generated Content

The emails generated by BodmasBooksAI are produced by artificial intelligence. You acknowledge that:

• AI-generated content may not always be perfectly accurate or suitable for your specific use case
• You are solely responsible for reviewing, editing, and approving all generated content before sending
• We do not guarantee any specific results, response rates, or business outcomes from using generated emails
• You retain ownership of the emails generated using your account

7. Intellectual Property

The Service, including its design, features, AI models, and underlying technology, is the intellectual property of BodmasBooksAI. You may not copy, modify, or create derivative works of the Service. You retain ownership of any content you input into the Service and emails generated using your account.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

9. Limitation of Liability

To the maximum extent permitted by South African law:

• The Service is provided "as is" without warranties of any kind
• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
